Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy describes how Body Brain Alliance, LLC (“BBA,” “we,” “our,” or “us”) collects, uses, discloses, and otherwise processes Consumer Health Data through bodybrainalliance.com (the “Site”), and the memberships, communities, coaching programs, digital products, and other services we provide (collectively, the “Services”).

This policy supplements our general Privacy Policy and applies to personal information that constitutes “Consumer Health Data” under applicable consumer health privacy laws, including the Washington My Health My Data Act and Nevada’s consumer health data privacy law.

1. CONSUMER HEALTH DATA WE COLLECT:

Consumer Health Data means personal information that is linked or reasonably linkable to an individual and identifies or may be used to identify the individual’s past, present, or future physical or mental health status.

Depending on the Services and features you use, we may collect:

  1. Mental-health, behavioral, and cognitive information, such as information concerning ADHD, neurodivergence, disabilities, mental health, trauma, stress, cognitive functioning, behaviors, habits, challenges, and personal circumstances;
  2. Physical-health and medical information, such as information concerning medical conditions, physical limitations, injuries, medications, symptoms, treatment, or other health-related circumstances;
  3. Nutrition, fitness, and wellness information, such as information concerning food, nutrition, exercise, sleep, activity, wellness practices, lifestyle changes, goals, habits, and progress;
  4. Coaching information, such as health-related or other sensitive information contained in coaching applications, questionnaires, activities, check-ins, trackers, messages, coach communications, progress updates, and other materials you choose to submit in connection with coaching; and
  5. Community and call information, such as Consumer Health Data you choose to disclose during group coaching calls or in posts, comments, questions, success stories, or other communications within a member community.

BBA does not require you to disclose more Consumer Health Data than is reasonably necessary to participate in the Services you request. However, because coaching and community participation may involve discussions of personal goals, challenges, habits, and experiences, you may voluntarily provide Consumer Health Data as part of those interactions.

2. WHERE WE COLLECT HEALTH DATA FROM:

We collect Consumer Health Data:

  1. Directly from you when you complete an application, questionnaire, activity, check-in, tracker, or other form;
  2. From your messages and communications with an assigned coach;
  3. From information you choose to share during group coaching calls;
  4. From posts, comments, questions, and other content you choose to share within a member community; and
  5. From your use of the coaching, community, and membership features made available through platforms such as Circle and Quenza.

3. HOW WE USE AND PROCESS CONSUMER HEALTH DATA:

We may collect, use, and process Consumer Health Data to:

  1. Review coaching applications and determine eligibility for or placement within a requested coaching program;
  2. Provide and personalize coaching, educational, community, and membership Services;
  3. Understand your goals, challenges, habits, experiences, and progress;
  4. Facilitate communications between you and your assigned coach;
  5. Review check-ins, activities, trackers, messages, and other coaching submissions;
  6. Facilitate group coaching calls and member-community participation;
  7. Record and transcribe group coaching calls;
  8. Administer, maintain, support, and secure the Services and member accounts;
  9. Respond to questions, requests, or concerns;
  10. Comply with applicable law; and
  11. Establish, exercise, or defend legal claims.

Consumer Health Data is processed electronically through the platforms and systems used to provide the Services. It may be associated with your member or coaching account, combined with other information you submit, and made available to authorized recipients as described below.

Where applicable law requires consent or authorization, we will obtain the applicable consent or authorization before collecting, sharing, selling, or otherwise processing Consumer Health Data, unless the processing is necessary to provide a product or Service you requested or another exception applies.

4. CONSUMER HEALTH DATA WE DISCLOSE:

Any category of Consumer Health Data described in Section 1 may be disclosed only as reasonably necessary to provide the Services you request, at your direction or with your consent, or as otherwise permitted or required by law.

Consumer Health Data may be disclosed to:

  1. Your assigned coach, when you submit the information through private one-to-one coaching messages, activities, check-ins, or other coaching communications;
  2. Your assigned coach and BBA’s Director of Coaching, when you submit the information through an Alliance Coaching application;
  3. BBA administrators and other members of the applicable community, when you choose to disclose the information through a post, comment, question, or other communication in a member community;
  4. Circle, which provides community and membership features used to deliver portions of the Services;
  5. Quenza, which provides activities, messaging, check-ins, and related functionality for Alliance Coaching clients;
  6. Video-conferencing, recording, transcription, and technology providers used to facilitate and process group coaching calls;
  7. Other service providers that process Consumer Health Data on our behalf where reasonably necessary to host, maintain, secure, support, or provide the Services; and
  8. Legal, governmental, or business-transaction recipients where permitted or required by applicable law.

Information submitted through private one-to-one coaching features is not treated as a community post and is accessible only as described above. Information you choose to post or share within a member community may be viewed by BBA administrators and other members of that community. You should not post information within a community area that you do not want other community members to view.

5. WHERE BBA DOES NOT DISCLOSE:

BBA does not sell Consumer Health Data. BBA does not disclose Consumer Health Data to advertising platforms or use Consumer Health Data to create advertising audiences. Advertising and analytics technologies used on the public Site are not intended to collect private coaching communications, coaching applications, check-ins, activities, trackers, community content, or other Consumer Health Data submitted through member or coaching platforms. BBA does not disclose Consumer Health Data to data brokers.

6. YOUR CONSUMER HEALTH DATA RIGHTS:

Depending on where you live and subject to applicable exceptions, you may have the right to:

  1. Confirm whether BBA collects, uses, shares, or sells Consumer Health Data concerning you;
  2. Access or request correction of your Consumer Health Data;
  3. Obtain a list of third parties and affiliates with whom BBA has shared or sold your Consumer Health Data, including available contact information;
  4. Withdraw consent and request that BBA cease future collection or sharing of Consumer Health Data;
  5. Request deletion of your Consumer Health Data; and
  6. Appeal a decision concerning your request.

7.  TO EXERCISE A RIGHT:

To exercise a right, email help@bodybrainalliance.com with the subject line “Consumer Health Data Request.” Please describe your request and provide information reasonably necessary to identify your account and authenticate your identity. You are not required to create a new account to submit a request. We will respond within the period required by applicable law. Where Washington or Nevada consumer health privacy law applies, we will generally respond within 45 days. We may extend the response period by an additional 45 days where reasonably necessary and permitted by law, provided we notify you within the initial response period.

If we deny your request, you may appeal by emailing help@bodybrainalliance.com with the subject line “Consumer Health Data Appeal.” If we deny the appeal, we will provide information about how to contact the applicable attorney general or regulatory authority.

When required by applicable law, we will delete Consumer Health Data covered by an authenticated request and notify applicable processors, contractors, and third parties that received the information. Deletion from backups may be delayed as permitted by applicable law, including for no more than six months under Washington law and no more than two years under Nevada law. Deleting information necessary to provide the Services may require cancellation of an active membership or coaching relationship or may prevent us from providing some or all of the Services. Content you post within a community may also remain visible where another member has copied, quoted, or independently retained it, or where retention is otherwise permitted by applicable law.

BBA will not unlawfully discriminate against you for exercising an applicable Consumer Health Data right.

8.  CHANGES TO THIS POLICY:

We will notify consumers of material changes to this Consumer Health Data Privacy Policy by posting the updated policy through the Site or applicable member platform and revising the “Last Updated” date above. If required by applicable law, we will provide additional notice or obtain consent before collecting, using, or disclosing previously collected Consumer Health Data for a materially different purpose or in a materially different manner.

If we collect an additional category of Consumer Health Data, process Consumer Health Data for an additional purpose, or disclose it to an additional category of recipient not described in this notice, we will update this policy and obtain consent or authorization where required before beginning the additional processing.
