This Privacy Policy describes how Body Brain Alliance, LLC (“Body Brain Alliance,” “BBA,” “we,” “our,” or “us”) collects, uses, discloses, retains, and protects personal information when you access or use bodybrainalliance.com and its related pages and portals (collectively, the “Site”), or purchase, access, or participate in our online courses, memberships, coaching programs, one-to-one coaching services, community features, digital products, email communications, and other products, content, or services made available by or on behalf of BBA (collectively, the “Services”).

Please read this Privacy Policy and our Terms of Use before using the Site or Services. BBA determines the purposes and means of processing the personal information described in this Privacy Policy, except where another entity processes personal information for its own purposes as described in its privacy notice.

By accessing or using the Site or Services, you acknowledge that you have reviewed this Privacy Policy. Where applicable law requires us to obtain consent for a particular collection, use, disclosure, or other processing of personal information, we will request that consent separately.

In this Privacy Policy, “personal information” includes “personal data” and similar terms used under applicable privacy laws and generally means information that identifies, relates to, describes, or may reasonably be linked to an individual.

  1. COLLECTING YOUR INFORMATION AND HOW IT IS USED

We collect personal information when you provide it to us, when you use the Site or Services, and from service providers and other sources that support the Services. The information we collect depends on how you interact with BBA, the Services in which you participate, the features you use, and the information you choose to provide.

A. Information You Choose to Provide to Us

We may collect the following information that you provide directly to us:

  1. Account and Contact Information: Your name, email address, telephone number, mailing or billing address, username, password, profile information, and other information used to create or manage an account or communicate with you.
  2. Enrollment and Application Information: Information you provide when applying for, enrolling in, or purchasing a course, membership, coaching program, or other Service. Depending on the Service, this may include information concerning your goals, habits, challenges, experiences, preferences, eligibility, and reasons for seeking the Service.
  3. Health and Wellness Information: Depending on the Services you use and the information you choose to disclose, you may provide information concerning ADHD, mental health, medical conditions, trauma, nutrition, medications, physical health, habits, behaviors, symptoms, wellness goals, and other health- or wellness-related information. Providing this information is optional unless identified as necessary to evaluate an application or provide a requested Service.
  4. Coaching Information: If you participate in Alliance Coaching or another individual coaching Service, we collect information you provide through coaching applications, private messages, activities, exercises, assessments, check-ins, documents, and other communications with your assigned coach. This information may include health and wellness information. Information submitted through an Alliance Coaching application may be accessed by your assigned coach and the Director of Coaching. Private one-to-one coaching messages, activities, and check-ins may be accessed by your assigned coach and other authorized personnel only as reasonably necessary to provide, supervise, secure, or administer the coaching Services.
  5. Community Content: If you participate in BBA’s community through Circle or another community platform, we collect information you include in your profile or submit through posts, comments, messages, discussions, and other community features. Community posts and comments may be visible to BBA administrators and other community members. Please use care when sharing information through community features because other members may view, copy, or reshare information you choose to post.
  6. Call Recordings and Transcripts: Certain group coaching, educational, or community calls may be recorded and transcribed using automated or artificial-intelligence-based transcription tools. These recordings and transcripts may include your name, image, voice, statements, chat messages, and other information you choose to share during the call. BBA does not record one-to-one Alliance Coaching sessions. We will provide notice when a group call is being recorded.
  7. Communications and User Content: We collect information you provide through emails, customer-support requests, surveys, forms, reviews, testimonials, social-media interactions, and other communications with BBA.
  8. Transaction Information: When you purchase a course, membership, coaching program, digital product, or other Service, we collect information concerning the transaction, purchase, subscription, and payment status. Payment-card or bank-account information is processed by our payment processor as described below.
  9. Marketing Preferences: We collect information concerning your newsletter subscription, marketing preferences, and interactions with our emails or other communications.

You may choose not to provide certain personal information. However, some information may be necessary to create an account, process a purchase, evaluate an application, access a community or course, or provide coaching or other requested Services.

Some personal information collected through the Services may constitute “Consumer Health Data” under applicable state law. Additional information concerning BBA’s collection, use, disclosure, and retention of Consumer Health Data, and the rights available to consumers, is provided in our Consumer Health Data Privacy Policy.

B. Information From Third Parties and Service Providers

We may receive personal information from service providers and other sources that support the Site and Services. For example:

  1. Payment Processors: Stripe and other payment processors may provide us with transaction information, payment status, billing information, and limited information concerning your payment method. BBA does not receive or store your complete payment-card or bank-account number.
  2. Course, Community, and Coaching Platforms: Providers that host or support our courses, memberships, communities, coaching programs, accounts, and related features may provide information necessary to create and manage accounts and provide the Services. These providers include Circle, which hosts BBA’s community and related content, and Quenza, which supports Alliance Coaching activities and communications.
  3. Email and Communications Providers: Email, customer-relationship-management, scheduling, and communications providers may provide information concerning your subscription preferences, appointments, and interactions with our communications.
  4. Recording and Transcription Providers: Providers used to host, record, or transcribe group calls may process recordings, audio, video, chat messages, transcripts, and related information. Certain transcripts may be generated using automated or artificial-intelligence-based technology.
  5. Analytics Providers: Analytics providers may provide information concerning the use, performance, and operation of the Site, portals, or other Services.
  6. Social-Media and Advertising Platforms: We may receive information when you interact with BBA through a social-media platform or respond to an advertisement. The information available to us depends on your interaction with the platform, its privacy settings, and the permissions you provide.
  7. Artificial-intelligence, automation, and analytics providers that process information on BBA’s behalf to analyze engagement, improve the Services, and support BBA’s internal operations.
  8. Other Sources at Your Direction: We may receive information from another person, business, or service when you direct or authorize that source to provide information to us.

C. Information Automatically Collected

  1. Automatic Data Collection: When you use the Site or certain online Services, we and our service providers may automatically collect information such as your Internet Protocol (“IP”) address, device type, operating system, browser type, device and browser identifiers, general location derived from your IP address, time zone, Internet service provider, referring and exit pages, pages or screens viewed, links or buttons selected, content and features used, and dates and times of access. We use this information to operate the Site and Services, maintain security, troubleshoot technical issues, understand how the Site and Services are used, measure the effectiveness of our communications and advertising, and improve performance and functionality. We may use analytics services, including Google Analytics or similar providers, for these purposes. Additional information concerning a provider’s processing practices is available through that provider’s privacy disclosures.
  2. Cookies and Similar Technologies: We and our service providers may use cookies, pixels, web beacons, server logs, local storage, and similar tracking technologies to operate the Site and collect information concerning its use. These technologies may be used to remember preferences; provide requested functionality; maintain security and prevent fraud; understand how the Site and Services are used; measure and improve performance; determine whether communications have been opened or acted upon; and deliver or measure advertising. Information collected through these technologies may include identifiers and other information that qualifies as personal information under applicable law. Some technologies are necessary for the Site and Services to function. Depending on your location and the technologies in use, you may be able to manage nonessential technologies through a cookie-preference tool, browser or device settings, or the other opt-out mechanisms described in this Privacy Policy.
  3. Advertising and Measurement Technologies: We use Meta Pixel and may use similar advertising or measurement technologies on the Site to measure advertising performance, understand interactions with the Site, and attribute registrations or purchases to advertisements. These technologies may collect information such as IP address, device and browser information, device or advertising identifiers, pages viewed, links or buttons selected, and information concerning registrations or purchases. BBA may also provide certain contact identifiers from its subscriber lists, such as email addresses, to Meta or another advertising provider to create custom audiences, lookalike audiences, or similar advertising audiences. Advertising providers may use this information to match subscribers with platform users and identify other users with similar characteristics. BBA does not intentionally provide advertising or analytics providers with the contents of coaching applications, private coaching messages, coaching activities or check-ins, community posts or messages, group-call recordings or transcripts, or health- or wellness-related information disclosed through the Services. Depending on applicable law, disclosures through advertising technologies or audience-matching services may be considered a “sale,” “sharing,” or processing of personal information for targeted advertising, even though BBA does not receive money in exchange for the information. Additional information concerning your choices will be provided in Section 4, “Communication, Tracking, and Account Choices,” and Section 6, “Sale, Sharing, and Targeted Advertising.”

D. How Personal Information is Used and Disclosed

  1. We do not use Consumer Health Data, private coaching information, group-call recordings or transcripts, or private community communications for advertising or marketing purposes. We may use personal information to:
    1. Create, authenticate, maintain, and secure accounts;
    2. Review applications, determine eligibility, process enrollments, and administer participation in the Services;
    3. Provide courses, memberships, coaching programs, community features, Digital Products, and other requested Services;
    4. Personalize coaching, educational content, activities, exercises, recommendations, and other aspects of the Services;
    5. Process purchases, subscriptions, payments, cancellations, refunds, and related transactions;
    6. Communicate with you about your account, applications, purchases, coaching, community participation, appointments, and customer-support requests;
    7. Send newsletters, educational content, promotional communications, and other marketing messages in accordance with your preferences;
    8. Host, record, transcribe, and provide group coaching, educational, or community calls;
    9. Monitor, maintain, troubleshoot, analyze, and improve the Site and Services;
    10. Measure the effectiveness of our communications and advertising and deliver or personalize advertising, subject to the limitations described in this Privacy Policy and our Consumer Health Data Privacy Policy;
    11. Protect the rights, safety, security, and integrity of BBA, our users, and others;
    12. Detect and prevent fraud, misuse, security incidents, and unlawful activity;
    13. Enforce our Terms of Use and other agreements;
    14. Comply with legal obligations and respond to lawful requests;
    15. Establish, exercise, or defend legal claims;
    16. Create aggregated or deidentified information that cannot reasonably be used to identify you;
    17. Carry out another purpose disclosed when the information is collected or with your consent; and
    18. Artificial-Intelligence-Assisted Analytics. BBA may use artificial-intelligence and automated tools to analyze information already collected through the Services, such as member activity, clicks, participation, and engagement with particular groups, features, or content. These tools help BBA perform internal analytics, understand how the Services are used, improve its programs and offerings, and make its operations more efficient. BBA does not use these tools to collect new categories of personal information, make decisions that produce legal or similarly significant effects concerning members, or infer medical or mental-health conditions. Information analyzed for these purposes is not sold or used for third-party advertising.
  2. We may disclose personal information to the following categories of recipients:
    1. Service Providers: We disclose personal information to providers that assist with payment processing, website and course hosting, account management, community functionality, coaching platforms, data storage, email delivery, customer-relationship management, scheduling, customer support, group-call hosting and recording, automated transcription, analytics, advertising measurement, security, and other operational activities. These providers include Circle, Quenza, Stripe, and other providers used to operate the Site and Services.
    2. Coaches and Authorized Personnel: BBA coaches, administrators, personnel, and contractors may access personal information reasonably necessary to provide, supervise, secure, or administer the Services. Your assigned coach may access your coaching application and information you submit through private coaching messages, activities, and check-ins. The Director of Coaching may access coaching applications and other relevant information as reasonably necessary to review applications, assign coaches, supervise the coaching Services, or address support, safety, or compliance concerns. Other personnel are not authorized to access private coaching information except where reasonably necessary to provide administrative or technical support, maintain security, comply with law, or address an urgent safety concern.
    3. Community Members: Information you choose to submit through Circle or another community feature, including profile information, posts, comments, and other community contributions, may be disclosed to BBA administrators and other authorized community members. Information submitted through a private community-messaging feature will be disclosed to the intended recipient and may be accessible to authorized platform or BBA personnel where reasonably necessary to provide support, maintain security, enforce community standards, or comply with law.
    4. Recording and Transcription Providers: Information included in a recorded group call may be disclosed to providers used to host, record, store, or transcribe the call. This may include automated or artificial-intelligence-based transcription providers. BBA does not record one-to-one Alliance Coaching sessions.
    5. Advertising and Measurement Providers: We may disclose certain contact identifiers from subscriber lists, device or browser identifiers, Internet activity information, and information concerning Site registrations or purchases to Meta and other advertising or measurement providers as described in Section 1(C). We do not intentionally disclose Consumer Health Data, coaching applications, private coaching communications, private community communications, or group-call recordings or transcripts to advertising providers.
    6. Payment Processors: Payment and transaction information may be disclosed to Stripe or another payment processor to complete transactions, prevent fraud, process refunds, and manage subscriptions or payment plans.
    7. Legal and Governmental Recipients: We may disclose personal information when required by law, legal process, court order, or governmental request, or when reasonably necessary to protect the rights, safety, security, or property of BBA, our users, or others.
    8. Business-Transfer Recipients: Personal information may be disclosed in connection with an actual or proposed merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar business transaction, subject to appropriate confidentiality protections.
    9. Other Recipients at Your Direction: We may disclose personal information when you direct us to do so, request a feature that requires the disclosure, or provide consent.

2. RETENTION AND SECURITY

A. Retention: We retain personal information for as long as reasonably necessary to provide and administer the Services and for legitimate business purposes, including legal, tax, accounting, security, fraud-prevention, and dispute-resolution purposes. Completing or ending a course, membership, or coaching program, cancelling a subscription, or ceasing to use the Services does not automatically delete an associated account or personal information. You may request deletion of personal information as described in Section 3, “Privacy Rights and Choices.” Deleting information necessary to provide the Services may require cancellation of an active subscription, membership, or coaching relationship or may prevent BBA from continuing to provide some or all of the Services. Certain information may be retained when reasonably necessary to comply with legal or financial obligations, complete transactions, resolve outstanding account matters or disputes, prevent fraud, maintain security, enforce our agreements, or establish, exercise, or defend legal claims. Information may also remain in archived or backup systems for a limited period before deletion through ordinary backup processes.

B. Security: We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, acquisition, use, alteration, disclosure, or destruction. These safeguards may include access controls, authentication measures, secure third-party platforms, vendor management, and limitations on employee, contractor, administrator, and coach access based on business need. Payment-card and bank-account information is processed through Stripe or another payment processor and is not stored by BBA in complete form. No method of transmitting information over the Internet or storing information electronically is completely secure. Accordingly, we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account to the extent authorized by you. You should not share your username or password with another person and should notify us promptly at help@bodybrainalliance.com if you believe your account or credentials have been accessed without authorization. Please do not send sensitive health, financial, or other confidential information through unsecured email or public community features. When available, use the private and secure communication features provided through the applicable coaching or account platform. If we experience a security incident for which notification is required by applicable law, we will provide legally required notifications in the manner and within the time required by law.

3. PRIVACY RIGHTS AND CHOICES

Depending on where you live and subject to applicable exceptions, some or all of the rights described below may be available to you.

A. Rights That May Be Available. You may have the right to:

  1. Confirm whether we process your personal information;
  2. Request access to personal information we maintain about you;
  3. Request correction of inaccurate personal information;
  4. Request deletion of personal information;
  5. Obtain a portable copy of certain personal information;
  6. Withdraw consent where we rely on consent to process personal information;
  7. Opt out of certain processing involving targeted advertising, the sale or sharing of personal information, or profiling, if applicable;
  8. Request that we limit certain uses or disclosures of sensitive personal information, if applicable;
  9. Obtain information concerning certain disclosures of your personal information;
  10. Appeal our decision concerning a privacy request; and
  11. Exercise applicable privacy rights without unlawful discrimination.

B. Submitting a Request

  1. You may submit a privacy request by emailing help@bodybrainalliance.com with the subject line “Privacy Request.” Please describe the right you wish to exercise and provide the information reasonably necessary for us to identify your account and verify your request. You are not required to create a new account to submit a request.
    1. We may request additional information to verify your identity and protect personal information from unauthorized access, correction, or deletion. We will use information provided for verification only to process and document the request. If we cannot reasonably verify a request, we may be unable to fulfill it.
    2. Where permitted by applicable law, an authorized agent may submit a request on your behalf. We may require proof of the agent’s authority and may contact you directly to verify your identity and confirm the request.
    3. We will respond within the period required by applicable law. If we deny your request, you may appeal the decision by emailing help@bodybrainalliance.com with the subject line “Privacy Appeal” and explaining the basis for your appeal.
    4. You may also update certain account or profile information directly through the applicable account or platform settings, if that functionality is available.
    5. Additional rights relating to Consumer Health Data are described in BBA’s Consumer Health Data Privacy Policy.

4.  COMMUNICATION, TRACKING, AND ACCOUNT CHOICES

A. Communication and Account Choices

  1. Promotional Emails: You may opt out of promotional emails by using the unsubscribe link included in the email or by contacting help@bodybrainalliance.com. Even if you opt out of promotional emails, we may continue sending nonpromotional communications concerning your account, purchases, coaching Services, appointments, security, or our ongoing business relationship with you.
  2. Account and Profile Information: You may be able to update certain account, profile, or communication-preference information through the settings provided by the applicable course, community, coaching, or account platform.
  3. Account Cancellation and Deletion: Cancelling a membership, subscription, course, or coaching program does not necessarily delete your account or personal information. You may request deletion by emailing help@bodybrainalliance.com. Certain information may be retained as permitted or required by law and as described in Section 2, “Retention and Security.” Deleting information necessary to provide the Services may result in cancellation or loss of access to certain Services.
  4. Cookies and Tracking Technologies: You may be able to manage cookies and similar technologies through your browser or device settings and, where available, BBA’s cookie-preference tool. Disabling certain technologies may affect the availability or operation of the Site or Services.
  5. Analytics: You may be able to limit certain analytics collection through controls offered by the applicable analytics provider. Google currently offers a browser opt-out tool at https://tools.google.com/dlpage/gaoptout. Additional controls may be available through your browser or device settings.
  6. Advertising Choices: You may be able to manage personalized advertising through settings provided by Meta, Google, and other advertising platforms. Depending on where you live, you may also have the right to opt out of the sale or sharing of personal information or its processing for targeted advertising as described in Section 3 and Section 6.

B. Tracking and California Privacy Disclosures

  1. Do Not Track: Some browsers offer a “Do Not Track” setting. Because there is not currently a universally accepted standard for responding to Do Not Track signals, our response may vary.
  2. Global Privacy Control: Some jurisdictions require recognition of qualifying browser-based universal opt-out signals, such as Global Privacy Control. Where required by applicable law, we process qualifying signals as requests to opt out of the sale or sharing of personal information or targeted advertising for the browser or device transmitting the signal.
  3. California “Shine the Light”: California’s “Shine the Light” law permits certain California residents to request information concerning disclosures of personal information to third parties for those third parties’ own direct-marketing purposes. BBA does not disclose personal information to third parties for their own direct-marketing purposes without consent. Questions may be submitted to help@bodybrainalliance.com.

5. ADDITIONAL INFORMATION FOR INDIVIDUALS IN THE EEA, UNITED KINGDOM, AND SWITZERLAND

If you are located in the European Economic Area (“EEA”), United Kingdom (“UK”), or Switzerland and applicable data-protection law applies to our processing of your personal data, the following information supplements the other provisions of this Privacy Policy. For purposes of applicable data-protection law, Body Brain Alliance, LLC is the controller of the personal data described in this Privacy Policy unless otherwise stated.

A. Legal Bases for Processing. Depending on the circumstances, we process personal data based on one or more of the following legal bases:

  1. Performance of a contract, including to create and manage your account, process payments, administer applications and enrollments, and provide courses, memberships, coaching, community features, digital products, and other Services you request;
  2. Your consent, including where required for marketing communications, nonessential cookies and tracking technologies, group-call recordings and transcripts, and health- or wellness-related information;
  3. Our legitimate interests, including operating, securing, maintaining, and improving the Site and Services; understanding how the Services are used; preventing fraud and misuse; providing customer support; maintaining business records; and protecting our legal rights, provided those interests are not overridden by your rights and interests; and
  4. Compliance with legal, tax, accounting, regulatory, or reporting obligations and the establishment, exercise, or defense of legal claims.

B. Special-Category Personal Data: Information concerning health, mental health, ADHD, medical conditions, trauma, and other health- or wellness-related matters may constitute special-category personal data under applicable law. Where required, we process this information based on your explicit consent or another lawful condition permitted by applicable law. You may withdraw your consent at any time, but withdrawal will not affect the lawfulness of processing conducted before consent was withdrawn. If you decline to provide or withdraw consent to information necessary to evaluate an application or provide a requested coaching or other Service, we may be unable to evaluate your application or provide some or all of that Service.

C. International Transfers: BBA is located in the United States, and personal data may be transferred to, stored in, or processed in the United States and other countries in which our service providers operate. These countries may have data-protection laws that differ from those in your country of residence. Where applicable law requires safeguards for an international transfer, we rely on a legally recognized transfer mechanism, which may include an adequacy decision, contractual protections approved by the applicable authority, or another lawful transfer mechanism. You may contact us to request additional information concerning applicable transfer safeguards.

D. Your Data-Protection Rights. Subject to applicable law and exceptions, you may have the right to:

  1. Request access to your personal data;
  2. Request correction of inaccurate or incomplete personal data;
  3. Request deletion of your personal data;
  4. Request restriction of processing;
  5. Object to processing based on our legitimate interests;
  6. Object at any time to processing for direct-marketing purposes;
  7. Receive certain personal data in a structured, commonly used, and machine-readable format;
  8. Withdraw consent where processing is based on consent; and
  9. Lodge a complaint with the data-protection authority responsible for your location.

E. Exercising Your Rights: You may exercise applicable rights as described in Section 3(B), “Submitting a Request.” Individuals in the UK may contact the UK Information Commissioner’s Office, and individuals in Switzerland may contact the Federal Data Protection and Information Commissioner.

F. Automated Decision-Making: BBA does not use personal data to make decisions based solely on automated processing that produce legal or similarly significant effects concerning you. BBA’s use of automated or artificial-intelligence-based technology to transcribe certain group calls does not make decisions concerning your eligibility for or access to the Services.

G. Additional Information: The categories of personal data we process, purposes of processing, categories of recipients, retention practices, and contact information are described in the other sections of this Privacy Policy. Certain personal data may be necessary to create an account, process a payment, evaluate an application, or provide requested Services. If you do not provide that information, we may be unable to provide some or all of the applicable Services.

6. SALE, SHARING, AND TARGETED ADVERTISING

BBA does not sell personal information for monetary consideration.

As described in Sections 1(C) and 1(D), we may disclose certain contact identifiers, device or browser information, Internet activity information, and information concerning Site registrations or purchases to advertising and measurement providers, including Meta. BBA may also provide certain contact identifiers from subscriber lists, such as email addresses, to Meta or another advertising provider to create custom audiences, lookalike audiences, or similar advertising audiences.

Depending on applicable law, these disclosures may be considered a “sale,” “sharing,” or processing of personal information for targeted advertising, even though BBA does not receive money in exchange for the information.

BBA does not sell Consumer Health Data or use or disclose Consumer Health Data for advertising or marketing purposes. BBA does not intentionally provide advertising providers with coaching applications; private coaching messages, activities, or check-ins; private community communications; group-call recordings or transcripts; or information concerning a person’s ADHD, mental health, medical conditions, trauma, nutrition, or other health- or wellness-related information. BBA does not create advertising audiences based on a person’s application for or participation in individual coaching or on health- or wellness-related information disclosed through the Services.

Depending on where you live, you may have the right to opt out of the sale or sharing of personal information or its processing for targeted advertising. You may exercise applicable rights by emailing help@bodybrainalliance.com with the subject line “Privacy Request,” through BBA’s cookie-preference tool where available, or through a qualifying browser-based universal opt-out signal as described in Section 4.

7. CHILDREN’S PRIVACY

The Site and Services are intended only for adults who are at least 18 years old. Individuals under 18 may not create an account, make a purchase, apply for or enroll in a BBA program, participate in a BBA community, or otherwise use the Services.

We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a person under 18, we will take reasonable steps to delete it. If you believe that a person under 18 has provided personal information through the Site or Services, please contact us at help@bodybrainalliance.com.

8. THIRD-PARTY SERVICES AND LINKS

The Site or Services may contain links to websites, applications, platforms, products, or services operated by third parties. BBA is not responsible for the privacy, security, content, or practices of a third party when that third party processes personal information for its own purposes.

Your use of a third-party website, platform, product, or service may be governed by that third party’s separate privacy policy and terms. We encourage you to review the applicable privacy disclosures before providing personal information to a third party.

This section does not limit BBA’s responsibilities concerning service providers that process personal information on BBA’s behalf as described in this Privacy Policy.

9. CHANGES TO THIS PRIVACY POLICY
